The Traffic Court here was told today that the cause of the fatal accident at the Duta-Ulu Klang Expressway (DUKE) last May could not be ascertained as the three vehicles involved were badly damaged.

Vehicle Examiner at the Wangsa Maju Computerised Vehicle Inspection Centre (Puspakom), Mohd Zakarifan Hassan said the badly wrecked condition of the vehicles made impossible to test drive them.

"I did a visual examination of the three vehicles and found them wrecked and impossible to test drive," he said when cross-examined by lawyer S.N. Seelan, representing Mohammad Fizal Reza Jamauddin, 31.

Mohd Zakarifan, who has seven years experience as a vehicle examiner, said he examined the three vehicles on May 5 this year.

He was testifying in the trial of Mohammad Fizal Reza and Siti Noor Aini Mohd Said, 36, the two Perodua Myvi drivers involved in the tragic accident.

They were charged with reckless driving which caused the death of three family members -- Fairuz Nizam Husain, 35, his wife Nova Safitri Azhari, 27, and their six-month-old baby Nur Firuza Annisa -- at KM6.2 DUKE Expressway from Ulu Klang heading to Jalan Duta, between 12.31 am and 12.35 am last May 2.

Earlier, questioned by lawyer Omar Bakhi Ahmad, representing Siti Noor Aini, whether he could determine if the three vehicles had faulty brake, Mohd Zakarifan he could not do so because the vehicles were wrecked and the brake could not be tested.

He said he only did a static examination of the outer part of the vehicles for 40 minutes with the vehicles placed on a carrier and the tires hanging.

The prosecution is conducted by deputy public prosecutor Nadiah Malek Fauzi and Suhaimi Ibrahim.

The hearing before Magistrate Zilfinaz Abbas continues on Jan 22 next year.
