Only children born overseas to Malaysian fathers who are married to foreign spouses are entitled to get citizenship by operation of law, the Court of Appeal held.

The Court of Appeal today ruled that the children born overseas to Malaysian mothers who are married to foreign spouses are not entitled by operation of law to be Malaysian citizens.

The judge ruled that the word "father" in the Second Schedule of the Federal Constitution must mean and include mothers.

Syahmi said not having a LTSVP should not be a reason to deny the woman or any other foreign spouses entry should they have permission.

Datuk Ismail Sabri Yaakob said the exemption was given to the group even though the country had not opened its borders to those countries.

Foreign spouses and children of Malaysian citizens who do not have a long-term visit pass can apply for permission to enter the country, said Immigration director-general Datuk Khairul Dzaimee Daud.
